What that seems to mean in this context is, "We ask the court to agree to open this case again if we find something eventually ..."

This was clearly a fishing expedition, but if Crytek ever does find a copyright violation... they're just putting CIG on notice. They haven't given up, just conceding the round.

Interesting...this all seems pretty funny to me, it's like, "Oh yeah, you aren't dismissing our case...we are just choosing not to amend it at this time, and we reserve the right to amend it again at some future date..."

But basically, they can't start all over again. They have to pick up where they left off with this, and it would seem that anything that would have given them a big win/big sum of money has been completely taken out of play.

If they are dropping the suit, there is no discovery. If they are not dropping the suit, the. It has been dismissed because they did not amend the complaint. The dismissal might be appealed, but I think it’s done.

I am sure Mr. French will weigh in soon.

Question is will they settle for some token amount to get rid of it, or continue to try and make it to discovery?

I think the question comes down to whether:

a) they thought they were going to get a nice fat payout
b) the entire purpose of this was to get to discovery so they can lift the new code developed on lumberyard.

They are trying to push out their own multi-player game, I guess that is possible.
